In the late 1970's it became clear that the State of Florida was behind in its attempts to clean up and improve the standard of care in hospitals providing care for elderly residents. This ultimately led to a 1980 Dade County Grand Jury investigation into negligence and abuses in nursing home faculties. The Florida Legislature took note and carefully examined the results of the Dade County Grand Jury investigation. Importantly, the legislature found that sixty percent of the nursing home facilities investigated were found to provide unacceptable or consistently very poor care for residents. The grand Jury report concluded that the state inspection and enforcement was very poor at addressing the problem of sub standard care. Against these findings, the Florida Legislature amended and adopted the Nursing Home Residents Rights Act (The Act) in 1980. The purpose of this Act was to create a list of rights belonging to residents and a remedy for enforcing violations of those rights. The Act itself is cited at Florida Statutes 400.022, and is explained in more detail in the Nursing Home Residents Rights Act section of this website. Mississippi, 297 U.S. 278 , 56 S. Ct. 461, 80 L. Ed. 682, the Supreme Court of the United States initially invoked the due process clause of the 14th Amendment to invalidate a state court conviction based entirely upon a coerced confession secured by physical force and violence against an accused by state officers. The evidence of the brutal physical abuse was undisputed. The Court concluded that the due process clause condemns such state action as being inconsistent "with the fundamental principles of liberty and justice which lie at the base of all our civil and political institutions." In Chambers v. Florida, 309 U.S. 227 , 60 S. Ct. 472, 84 L. Ed. 716, the United States Supreme Court concluded that a state court confession obtained under circumstances amounting to mental and psychological torture of the accused, is afflicted with the same vice as one obtained by physical abuse. As a result of these decisions the matter of the voluntariness vel non of a state court confession was elevated to the level of federal constitutional concern. To date there has been no change in these general propositions whenever confessions in state criminal proceedings have been subjected to the 416 test of 14th Amendment due process. The rule applicable to state courts is that whenever a consideration of "the totality of the circumstances" fails to reveal coercive forces sufficient to overcome the volition of the accused the confession will be upheld regardless of compliance with procedural stipulations such as those announced in Section 901.23, Florida Statutes, F.S.A. The crux of the requirement is that the confession be voluntary. If it is, it is admissible in the state court. Obviously the objective is to prevent physical or mental tortures which have been known to induce innocent parties to confess crimes which they did not commit, as well as to afford full protection against compelled self-incrimination. See, "Why Men Confess" by John Rogge. To request one of these free resources, or to discuss a specific legal matter with an Orange County injury lawyer , feel free to call 866-981-5596. I think plaintiff's attorneys' and insurance companies' interests are aligned on this point: the plaintiff's attorneys are spending money taking those depositions, too, and I don't know any plaintiff's attorney who would not much prefer being able to hone the case down to the real culprit before even considering filing suit. It saves expenses, time, energy, and frustration. Evidence at the trial showed that Squires was angry because he felt he was going to get cut out of a $400,000 loan his mother took out against their residence. Similar to ordinary negligence cases, these lawsuits require proof of the four elements of duty, breach, causation, and damages. However, medical malpractice claims generally rely on expert testimony to establish the professional standard of care, which is defined as how a competent health care provider in the same specialty as the defendant would have treated a patient similar to the injured person in the same circumstances. Experts also will be vital to show how the defendant fell short of the standard of care and how this breach led to the harm that the victim suffered. 8. David Kohn. CBS 60 Minutes. However, when someone is invited to a business as a customer or into a home as a social guest in the event they are injured, the owner of the property generally can be held responsible if he knew or should have known of the inherent danger which caused the injury of the victim such as broken or separated floor tiles, stairs in disrepair or unattended swimming pools with no restrictions to prevent small children from falling into the water and drowning. The only evidence is that prospective parents were informed on August 22 that the birth mother was HIV positive, and they then had the child tested. The child was reactive for HIV antibodies.2 The record also indicates that there was a conversation between the prospective mother and Wellspring in which Wellspring offered to find foster placement. The prospective parents, after taking some time to consider whether they wanted to keep the child, decided to keep her, notwithstanding her health problems. On September 11, 1997, the child was found dead. The autopsy report listed the cause of death as SIDS. There is no evidence that her death was related to her HIV status.
