I reluctantly agree with the majority's conclusion that the circuit judge did not erroneously exercise his discretion in holding that the defendants waived their statutory right to a jury trial.? Because the circuit court did not employ the proper standard of "excusable neglect," this court's decision must rest entirely on the facts in the record, and specifically the fact that the defendant, more than 15 months before trial, paid the jury fee 11 days late.? The defendants did not comply with the applicable Milwaukee County Circuit Court rule regarding payment of the jury fee and, as a consequence, they did not get a jury.? See majority op., 34-35.? Our affirmance of the court's ruling sets an extremely high bar to reverse excusable neglect determinations in future cases.? Nonetheless, I would affirm and take this opportunity to discuss the disparity among local rules governing the payment of jury fees.? The court disagreed with the Wife's argument that as of date of separation (V-Day), the sale of her ACCE shares was sufficient evidence to support a $364,884 valuation of her Share Disposition Costs. Basically, the law states that a doctor, dentist, nurse, etc. must act within the same standards as other persons in their profession within the same or similar community at the time of the alleged medical malpractice action. In other words, a heart surgeon should practice and use the same guidelines and procedures as other heart surgeons in similar communities. As an exaggerated example, all heart surgeons do not use chain saws to open a patient's chest. If a heart surgeon were to use a chain saw and injure the patient, then that doctor would had violated the standard of care. He should have known the use of the chainsaw was not within the standards for heart surgeons. Lansing Community College: adjunct professor, Criminal Procedure, 1993-1997
Can I lose my right to pursue a lawsuit if I didn't follow a doctor's instructions? This is an appeal by two securities purchasers from a preliminary injunction obtained by the Securities and Exchange Commission in a case of alleged insider trading. This case is unusual in that, as prepare a detailed introductory letter to the seller (or his/her lawyer) requesting extensive preliminary information from the seller such as information concerning (i) the ownership of the equipment; (ii) liens; (iii) lease; (iv) employment contracts; (v) creditors; (vi) other relevant information; This evidence overwhelmingly suggests that the standard of care for most dental procedures is to keep a patient on their anticoagulants or antiplatelets. Removing these patients creates an unnecessary risk of stroke. Every dentist confronted with a patient on anticoagulants should be sure to take a thorough history including whether the patient is on anticoagulants or antiplatelets, how long the patient has been on their medication, their therapeutic range, and how often their INR is checked. The dentist should further speak with the patient's physician to determine why the patient is on these medications and whether it is safe to take the patient off for a procedure. The fee program provides presumably adequate medical care at a nominal cost and ensures that no inmate goes without medical care for fiscal reasons. Just as Plaintiffs state that the program discourages the seeking of medical care, we can just as easily state in the alternative that the program forces inmates to make responsible decisions. If this results in inmates seeking medical care less frequently, it is by their own volition. We refuse to impute deliberate indifference to the prison merely because some inmates might make irresponsible choices. Twelfth Judicial Circuit Court of Florida - Sarasota (South County) Chandrasekhar vs Apollo Hospitals Enterprises Ltd., 1994 I.L.W. 68 (Mad-HC) (DB) The trial judge properly submitted to the jury the determination of the validity of the confession. It was the function of the jury to resolve the conflicts in the evidence relating to the threats allegedly made toward appellant to obtain his confession. The jury, unfortunately for appellant, apparently believed the testimony of the State's witnesses as it had the right to do. We are unable to discover any error in their decision. KIRKLAND, Wash., Feb. 13, 2013 (SEND2PRESS NEWSWIRE) - Until recently, long-term care financing has been offered to Americans primarily in the home; and the means of financing has been limited to LTC insurance, for the most part. That's no longer so with LTC Financial Partners, LLC (LTCFP), one of America's largest and most experienced LTCi agencies. 1. Claims for personal injuries due to - for example - tripping on an uneven surface in the hospital car park or contracting food poisoning in the hospital canteen are what are known as public liability claims.
Given the name, it is very possible that St. Joseph's is a Catholic hospital. Catholic hospitals here in New York treat those who have no insurance, and those whose insurance benefits have run out. They also treat many illegal aliens. While the hospital didn't respond to Ms. Cohen's request for information, it is possible that they charge more to those who have insurance to offset the costs of treating those who don't. An article appeared recently in the New York Times about St. Vincent's Hospital, which is just about bankrupt, stating that unlike other hospitals, it continues to treat those who cannot afford care. Other Catholic hospitals in the city have closed because of financial problems - they too treated those who could not afford care. With these principles in mind, we turn to the facts of the present case. The defendant called the following evidence in relation to liability: Context The patient-centered medical home (PCMH) model of care is currently a central focus of U.S. health system reform, but less is known about the model's implementation in the practice of everyday primary care. Understanding its implementation is key to ensuring the approach's continued support and success nationally. This article addresses this gap through a qualitative examination of the best practices associated with PCMH implementation for older adult patients in primary care. Methods I used a multicase, comparative study design that relied on a sensemaking approach and fifty-one in-depth interviews with physicians, nurses, and clinic support staff working in six accredited medical homes located in various geographic areas. My emphasis was on gaining descriptive insights into the staff's experiences delivering medical home care to older adult patients in particular and then analyzing how these experiences shaped the staff's thinking, learning, and future actions in implementing medical home care. Findings I found two distinct taxonomies of implementation best practices, which I labeled hard and soft because of their differing emphasis and content. Hard implementation practices are normative activities and structural interventions that align well with existing national standards for medical home care. Soft best practices are more relational in nature and derive from the existing practice social structure and everyday interactions between staff and patients. Currently, external stakeholders are less apt to recognize, encourage, or incentivize soft best practices. Conclusions The results suggest that there may be no standardized, one-size-fits-all approach to making medical home implementation work, particularly for special patient populations such as the elderly. My study also raises the issue of broadening current PCMH assessments and reward systems to include implementation practices that contain heavy social and relational components of care, in addition to the emphasis now placed on building structural supports for medical home work. Further study of these softer implementation practices and a continued call for qualitative methodological approaches that gain insight into everyday practice behavior are warranted.
